Sirkin is a smart guy. He made some solid arguments. I am disappointed that the 11th Circuit thumbed their collective noses at the Ninth Circuit's decision that a national community obscenity standard should be used for the internet, but thats Florida. For the most part they arent adult friendly.

The decision will be interesting but I doubt he will win -- just a hunch based upon their feelings towards the Ninth Circuit's decision in Killbride.

I visited him in the Federal holding facility in downtown LA in early September. He was in good spirits, and was hoping his appeal would be successful. For a guy thrown in jail for doing something he didn't do, his attitude was remarkable.

I really doubt that any of the keyboard warriors in this thread could deal with the Kafkaesque situation Max has found himself in.

Good points, but plesurepays has a serious dislike for Max hardcore. Nothing you intelligently point out will make him see anything other than Max did it and he is being punished rightfully for it.

What pleasurepays does not get is that Max is getting punished under a bad ruling due to a very poor interpretation of the obscenity law.

This poor law interpretation and bad ruling has serious consequence for the adult industry down the road, if it is not over turned.

Im cool with Max getting jail time for assault and battery or even rape(if the facts support it). I really dont give a shit what happens to the guy. But i do care when Max gets his civil liberties taken away.

WHY DO I CARE?? Because if his can be taken away, so can mine.

You need to look at this case for the facts and without your personal feelings about Max Hardcore. If you can do that, you will really see what a travesty this case decision really is.

But that state sucks donkey dick when it comes to adult content .. Cash Titans took a hard hit from Florida as well .. Max in a mental case but I like him as my wacked out friend .. We've had good times .. I hope he gets out .. long and short of "obscenity" is that it SHOULD be based on community standards .. and knowing that he should NOT have shipped to a state that hated his content .. this is not a new issue .. we have always watched out about shipping content to states that have issues with whatever content we are shipping .. there are still states that have vibrator laws ... he is the owner of the company and liable for said companies actions ... __________________ No sig .. just me

He was in good spirits, and was hoping his appeal would be successful. For a guy thrown in jail for doing something he didn't do, his attitude was remarkable. I really doubt that any of the keyboard warriors in this thread could deal with the Kafkaesque situation Max has found himself in.
