Democrats' Health Bill: Buy Insurance or Go To Jail

The Democrats' bill that will be voted on in the House tomorrow says a family of four either needs to buy insurance for $15,000 per year, pay a penalty tax of 2.5% of income or face a penalty of up to $250,000 and/or imprisonment of up to five years. This should be popular.

How is quoting specific passages from the House Healthcare Bill spreading lies??? Are you really that delusional that you are incapable of coherent thought on the issue? Section 7201 and 7203 are the Internal Revenue Code sections that would be applicable for failure to pay the 2.5% penalty tax. The penalty tax is assessed for failure to purchase insurance that meets the requirements of the statute. If any of you nitwits had even a passing familiarity with the debate on this issue you would be aware that the mandatory insurance requirement would have penalties attached for noncompliance. Otherwise how would it be fucking mandatory???

I read through the letter you linked and I do agree that a person who doesn't maintain health insurance during the year probably should not be penalized. I can, however, see why they would do this.

One of the major problems with health care is the non-payers. These are people who go to the ER and urgent care centers and get treatment then don't pay. That cost is then passed on to everyone else. So if a person just doesn't want health insurance for no legit reason and ends up becoming a non-payer we all then get to pay for them. You are forced to carry car insurance if you drive, I think they are using the same principles here. I also think they are expecting to supply enough subsidies that anyone can get health insurance no matter how little money you make so the only reason for not having it would be that you just decided that you don't need it and don't want it even if the government is paying for it.

Still, sending someone to jail over this is pretty extreme. However, if you read the full letter at the bottom it says that out of all the cases they were filed in 2008 only about 100 were cases where they determined the taxpayer?s unpaid tax liability results from willful behavior. Obviously this doesn't include health care since we don't have it yet, but I think the point is that very few people will fall into this area. The rest will just be taxed what it would cost them to have health insurance. From what I read you can make up to around 80K a year and you will still get some kind of government assistance for health insurance so I don't think this clause will effect many people.

I think a lot of it is indicative of our government as a whole. They rush a lot of things and then try to paint with too big of a brush. COPA is a great example. They wanted to make it so that porn sites could not be accessed by kids. Had they took their time and crafted a good bill they could have done just that. You can argue for or against what it would have done to this industry. However, they made an overbearing, overreaching law that covered half the sites on the internet. The same with 2257. It worked fine, there had never even been an inspection, yet they changed the laws and made following the law perfectly nearly impossible (not to mention next to impossible to figure out)

These guys don't seem to have a scalpel, all they know is jackhammer and they end up doing too much.

Hell, I bet most of the people that will be voting on the bill in the next few days haven't read it and don't really know what is in there.

You do realize that when you're a prisoner, the tax payers fund your health care, right? They pay for all your care, your health issues, your medications, etc.

Tax evasion is a crime in and of itself. It is not related to the health care bill. The penalty for not having health insurance is 2.5%. Everything else is seperate.

What you are essentially saying is this. I get a parking ticket and show up to court. I start yelling obscenities at the judge and get charged with contempt of court and serve 30 days in jail. Therefore, the penalty for parking illegally is 30 days in jail.

Failure to pay a fine or serve your sentence is a completely different crime in this country. Before you spout off on people calling them illiterate, you should educate yourself on our judicial system before you continue to make a larger fool of yourself.

And my post is not a statement in favor or in opposition of the proposed health care bill.

Every single crime in this country is punishable by jail time if you don't pay your fine or fulfill your sentence. You can go to jail for not wearing your seat belt or watering your lawn during restricted times if you don't pay your fine.

Your title says if you don't buy insurance, you go to jail. That is not true. You only go to jail if you commit tax evasion which is another crime. You are the one intentionally obfuscating the issue by leaving an extremely important fact out of your initial statement.
