Fugitive Sam Jain et al are also known for their spyware exploits, and some here have suggested might possibly be in bed with Fabian Thylmann / Manwin now, who has suddenly also become quite reticent.

Not saying there is a connection, just noting a trend.

My memory is bad but didn't Quickbuck (hooper wiseman) buy it from John? The interesting thing was (according to the post I linked to above) when people noticed the virus was the same time the site claimed to have been sold but John's info was still on the domain. I think it turned into a finger pointing match between the buyer and seller to who was doing the virus shit. Maybe some digging can shed more light on it.

The sad thing is we spent money on attorneys to see what we could do about the problem. (unlike the whiners like most folks here that just want to yelp and not actually do anything) We found that taking the course of action we took would be best - and that means making the best of a bad situation. Anyone that has seen a law suit all the way through knows that it is expensive and even with overwhelming evidence the outcome is uncertain. We took the path of trying to fix the problem and work with the issues. You don't like it? Show me something better.

If you were a content producer, then you would understand what some of the "bitching" is about, since it shouldn't be too hard to understand that if you spend significant money to create content, you wish to profit from the content you created, and decide whom else may or may not financially benefit from it as well. At it's essence, that afterall is what copyrights are all about.

Stealing is a violation of the law and wrong, and hiding behind loopholes in the law, is both morally and ethically, equally wrong. Unfortunately, some people in this industry are severely lacking in morals and ethics, or are willing to get in bed with what I can only regard as thieves, in a feeble attempt to protect their stake in the biz, not fully realizing that once they have exposed their vulnerability and weakness to the predators, it will only be a matter of time until they are devoured by the same predators whom they have supplicated themselves/their companies before.

It is undeniable that the DVD market is reeling, and pretty much on its knees, from their content being ripped off (or them selling off old catalogs in a desperate attempt to remain in business), and with internet pirates ripping and offering tons of their content (much of which was originally shot exclusively for DVD) for free on tube sites who are subsidizing their bandwidth and profiting using stolen/unauthorized content (like the bandits they are), by making money from companies advertising other non-video products (pills, dating services, cam shows, toys, etc), or upselling memberships to even more/better content (much of which is also alleged by some to be stolen).

In doing so, they have massively drained the traffic (the life-blood) from the traditional internet-based affiliate programs and paysites.

On top of all this, shamefully, many of the largest producer/content reseller companies are being co-opted, or are offering up snippets of their content, in what almost appears to be a quasi protection racket (extortion), to ensure that the bulk of their content is not wholesale stolen and uploaded, in exchange for relatively meager profits or link-backs posted alongside several upsells and traffic leaks which they gain no benefit from whatsoever, which likely yields very little to them for their cooperation/participation, compared to what they might otherwise make if they would band together to fight content piracy, and create a better, more equitable, infrastructure for the industry as a whole.

Don't get me started about the producers such as Brazzers and Mofos (aka Mansef) that are/were behind many of the worst offending tube sites themselves, despite their lies and deception about not being involved.

And still some would defend these people?!?

I am about to jump out here because it is just getting ridiculous but I just want to say that I still call you a friend, one of the few people I would trust in this biz, and one of the only ones here that contributed anything worthy of debate and discussion here. We may have different ways of dealing with this issue and opposing views on the matter entirely but I respect where you are coming from. Sorry that our way of dealing with it would cause any friction or misunderstandings, but we all have to pick our own way through the minefield of day to day biz so to speak. War is hell.

I understand Farrell. I assume that you know I have been consciously avoiding debating with you precisely because I do consider you a friend, and one of the most knowledgeable people in the business.

You have articulated your positions quite well, and while I might not agree with all of them, I do understand them.

I am not trying to be a gadfly here, I genuinely would like to see the questions which I posed to Nathan / Fabian answered. To me, that would go a long way towards establishing whether we will see any real changes with Mansef / Manwin, or if it will be just more smoke and mirrors, and business as usual.

Finally, I don't think that it has to come down to an "I told you so" moment between you and I, since there is certainly more than one way to conduct business, and I like to think that our friendship runs deeper than that.

You aren't a bad guy and I apologize for busting your balls. You are free to criticize us as you see fit. Hopefully, you can hear me on these simple points. We don't condone theft of content. We know that all the "user" submitted tubes exist in a grey area of being considered "theft" - and this is true for mainstream as well, ie, YouTube before it was cleaned up, etc. We took the time and effort and expense to weigh this problem in depth and decided on a course of action that is highly controversial. We did not make the decision lightly.

You say they are "theives" but forgive me, until that is proven by something like the PV lawsuit, or government crackdown, or whatever, I have to go by innocent until proven guilty. People call Google and Bing theives for the same reasons. Do you think they are? I have not had the problems others encountered. Why should I go by anything else that people I don't even know claim? How do I know their intentions? What if someone claimed someone you work with and have only had a good experience with was bad? Would you go by the accusation of someone you don't know or the experience of your own relationship? We work with Google and Bing to make money, even though they "stole" a ton of our content. Right or wrong. Ethical or unethical? If only it were so simple.

I know that sharing this has prompted such criticism and ridicule but hopefully people can see that there are a lot more intricacies to this than just who or who didn't upload content. On that count, it is not a matter of us not caring as people here accuse, it is a matter of taking control of the situation in a way that doesn't hurt us with costly litigation against an uncertain outcome, that can reverse a loss to a profit, and that adjusts to the ever changing landscape of how the industry evolves. We wish it could be as black and white as you see it, if it were, trust me, I would be in total agreement, but that is just not the case. For us, there are so many shades of grey and we have to find our own way through that fog. Sorry that we have to be at odds as a result.

My apologies - I am getting a bit sensitive for obvious reasons.

I can explain that perhaps more clearly by saying that if my car is one of those that has been plastered with ads like a metro bus then someone driving it around before I got it back isn't hurting me too terribly. Inconveniencing, yes, but at the end of the day it was not a total disaster. Would I want them to ask next time? Yes. Would it be ok to do it with out asking? No. Of course not. But I blame myself for leaving the keys out and will take steps to avoid that in the future. Hope that makes more sense.

8) What business relationship/association(s) have you, or any companies associated with you, (such as Virage Media or HQtube and Xtube) had with Envisionext/Stan Fiskin?

9) What business relationship, if any, do you have with Jain Shaileshkumar (aka Sam Jain) or Bjorn Daniel Sundin (aka Daniel)? Some people here seem to think there is a money connection somehow.

10) Would you consider contributing some of Manwin's profits to an industry-wide anti-copyright/anti-piracy effort?

I'm simply asking questions which I perceive that you have repeatedly ducked, dodged, and otherwise parried from.

None of the information I have posted is personal (even if you or anyone else chooses to take it personally).

Most, if not all, of the info I have posted about, came from easily accessible public sources on the internet, such as LinkedIn, and Google searches of your name, your nicks, and your various company names, plus names of people associated (or said to possibly be associated) with you.

I assure you that I have not hacked into anything that is private or otherwise secure information. That is outside of my nature/proclivity, and skill-set.

If you wish to be perceived as a respectable member of the adult industry, by answering forthrightly, the simple questions which I have posed here, and prove yourself to sincerely and aggressively stand against content/copyright piracy (not just for your own content, but for the entire industry), then you may be surprised to find a strong ally in me.

By refusing to answer these questions, many people may possibly have to conclude that you indeed have something to hide, and are therefore untrustworthy, or that you may be too busy serving the hidden partners pulling your strings to come clean about your company:
