The shoot out would lead to, more people dying in the cross fire. It always amazes me when the picture clearly shows the problem.

If this guy wasn't a total psycho he would have told the waitress to fuck off and walked on the check -- that would be the rational thing to do or just go outside and finish the cigarette.

Had the waitress been smart she would have just told the customer that he could step out and finish his cigarette. Even if he had walked out and stiffed her on the check -- she might not have ended up with her brains splattered on the floor. Certainly not worth enforcing the law as her job was as a waitress.

On the other hand whatever she said might have set this psycho off ...

The waitress was caught in a no-win situation. She's been told about the law, her manager has likely made it part of her job responsibility to deal with smoking patrons...yet she's in no position of actual authority to enforce anything. Caught between the proverbial rock and a hard place.

And sadly, she paid with her life.

Let me make one thing perfectly clear - I was NOT placing any sort of blame on the waitress. She was 100% victim here. I was putting partial blame on a legislative system that puts people in a potentially confrontational position with the general public WITHOUT any sort of training or means to enforce their position or safeguard themselves.

Obviously the large bulk of the blame goes to the psychotic asshole with the gun. And again, the broken system that allows unstable individuals like him to possess a gun in the first place.

I have an employee/co-worker who, as a small part of her job responsibility - is to deal with people smoking on municipal-owned property under terms of the newest legislation prohibiting smoking on any municipal land. At present, she's received no formal training of any kind from our company, the client we contract with, or other governmental agency in handling these potentially hostile situations. She is not trained in the use of force (as in self-defense), conflict resolution or de-escalation techniques. As a result, she simply verbally advises people they're not to smoke on the premises, walks away and observes from a distance - and if they don't leave or put out their smoke, she calls a regional by-law enforcement officer to attend the scene. She is not to engage the individual further herself.

The law is in place - with no mechanism to properly enforce it.

I partially agree - however...we don't know the backstory - did she have a boss/manager that gave her the responsibility of going out and dealing with the smoker? Was there complaints from other patrons? Did she feel pressured to confront the smoker?

You, I...and others may see it as a "petty rule" - but that's from our perspective on the sidelines. To a waitress earning a meagre wage possibly afraid of being fired for not doing what she's told - it may have been more than a "petty rule" at the time.

I'd say its fixable by looking at the healthcare system.

Fire chief Joe Boney told The Sun Herald Mount was a former fire-fighter who was badly injured in a 2002 traffic accident.
