Let me spell it out for you, I am an Australian citizen, anything I do which is legal in another jurisdiction has no interest to Australian law, neither would US law apply as all this talk of DMCA and Safeharbour is greek to me.

The problem is magnified if some offshore company owned by a group of other entities actually did the job. Then the only thing you'd get if you could even sue at all, would be the assets of the company because it would be the legal entity you may be able to sue.

Of course, as any good Phoenix knows, you just rise from the ashes while your opponent burns themselves to death wasting cash suing something with no value, therefore you might get a judgement but no actual enforcement.

I think you underestimate me Nathan, I do not lie, I am straight up with everyone in this business and all business, even my opponents. I have had some quite interesting contacts from people over this idea, you can believe what you want, I don't care.

Will I get this done ? I don't know. However I think I have found your one weak spot, your one little vulnerability and that makes me happy.

No, you didn't. The user had only 1, ONE, video, and that can't make him repeated infringer. User was booted for something else. But you still don't understand that logic, do you?

To keep the safe harbor, not only must they ban the infringer, they must also not have actual knowledge of the videos (with or without DMCA notices), and they must act upon obvious or suspected infringements.

A. Putting up a site with 10,000 full length videos of which the core could be anyone's is simple. The problem is affording it. Unless you get a some people to pay the hosting, BW, labor costs. You're losing money. Big time. Fabian might have a clue what his hosting bill is, but I suspect it's another thing delegated to others that he doesn't know.

Of course asking anyone doing business with Manwin to support you or get them to advertise isn't going to get a great response.

B. Suing someone for doing something not illegal in their home country isn't easy or cheap. And the success of it would leave you with what? A line of people doing exactly the same thing and not posting on GFY. In fact people who you might find tough to track down. Acacia who were a team of lawyers couldn't sue me in Czech. Because Czech hadn't signed up to the patent law they were using.

Then you need to prove AdultKing actually did the deed and not just the man who came up with the original idea. How do you intend to do that?

What experience do you have of doing this Fabian?

C. DWB's post about Manwin buying up servers. That could cripple them. How many servers would they need to buy if people adopted the idea?

D. Manwin's position as the biggest in the business, if based on Tube traffic, isn't going to mean squat in time. Tubes are just another costly tool to teach people not to pay for porn. Something online porn has been very successful at. So who ever you are Tubes are going to teach more and more customers not to pay for porn.

If there success is based on what's inside their sites, then I'm amazed. Because what's inside their sites isn't that good. As I showed when I did the reviews of some of the scenes.

They don't really want their tubes free of piracy. They don't want unwatermaked short videos hogging up space on their site when they could have long videos from paysite members areas that attract traffic and if it gets DMCA'd something similar will just take it's place. The trick I'm sure is to get the illegal shit posted long enough to grab some SE traffic from people looking for paysite content on tubes. If the videos get DMCA'd who cares, they've already secured another visitor.

How much full length scenes does it take to get the massive traffic the top division have built over the years.

How much money will be made from advertising during the time building the traffic.

And will it cover the hosting bill?

I would estimate that it would need a dedicated server and the cost would be high for the BW at the start. As the traffic grows, then the price gets better. Or invest in at least 2 servers and take a deal that will allow you to use more BW than you burn and invest the money until the traffic starts to STICK.

Getting and keeping traffic with 3-5 minute clips only isn't going to cut it. People want 20 minute clips.

Then ratios plummet.

So you're stuck between a rock and a hard place.

If I were Fabian I wouldn't bother to threaten AK, I would let him know what the investment is to go into competition with Pornhub.
