This "minor" charged over $100 worth of memberships to my sites over the last two weeks, what would you say to his dad?

He can't be too learning disabled if he knew where to type in the exact credit card numbers, the name, the expiration date, and the authorization numbers. Plus, he was able to find several of your sites and charge them with the same card. Fuck, I have a hard time figuring those damn things out sometime, how is some learning disabled kid doing it? I've been selling stuff via credit cards for years, and believe me in just about any dispute between a merchant and a customer, the merchant loses virtually automatically. Give up the dough and chalk it up to experience. If you make a big to-do over it, you won't win any friends, especially at the credit card company.

I'd show the email to the processor that handled it and see if they won't be willing to take a hard line with the guy if he calls in for a refund.

It's all but impossible to keep the cb from happening, but with any luck the guys bank will force the card it was charged on to be invalidated and good ole Cameron will have to get a new card, which could take a couple weeks.

If all the joins were done at once, I could see where the father might be telling the truth.

But if they were done over a period of time, then no, that's not the behaviour of a mentally incapicated child, that's someone looking at porn and then wanting to get out of paying.

Or there is always the tactic of putting the burden of proof on him, IF you actually intend to respond to him.

I'd tell him that unless he can prove that he has a disabled child who did this, you will seek redress, in the form of criminal charges against BOTH of the kids (its not so important whether or not you would do it here) and a civil complaint against all of them for conspiring to defraud your company.

While it's really hard for a cc processor to fight a cb and win -- and the cost incurred to third party processors is more than the $15 "administrative" fee that is charged (aside from any fines should your processor be in less than good graces with the cc company), depending on who took the charge they might take the correspondance from the parent and attempt to fight it.

The trick of course is to get the 'father' to either lie or admit that there's nothing that should be cause for a chargeback.

Well, I don't operate a pay site, and I don't know much about this type of thing, but I would be inclined to say:

dear sir:

I am sorry to hear of your situation. I will refund your money.

Of course I do not want minors to access my site.

You should be aware that I have already incurred the costs of your son's transgression, includiing advertising costs, credit card processing fees, bandwidth costs, and licensing fees for the content that he viewed.

It is not unheard of for adults to attempt to defraud pay sites with similar claims. This is of course credit card fraud, punishable by ... etc...blah blah.

To receive your refund, simply send a signed written request for a refund and a copy of your son's birth certificate (or other legal documentation of his age and address and relationship to you) to:

[Your corporate address.]

In addition, I would appreciate receiving a call from your son (XXX-YYY-ZZZZ) to appologize to me for the costs that I have incurred as a result of his indescretion. Such a call can significantly speed your request through our fraud detection procedures.

It's all but impossible to keep the cb from happening, but with any luck the guys bank will force the card it was charged on to be invalidated and good ole Cameron will have to get a new card, which could take a couple weeks. If all the joins were done at once, I could see where the father might be telling the truth. But if they were done over a period of time, then no, that's not the behaviour of a mentally incapicated child, that's someone looking at porn and then wanting to get out of paying.

I'd tell him that unless he can prove that he has a disabled child who did this, you will seek redress, in the form of criminal charges against BOTH of the kids (its not so important whether or not you would do it here) and a civil complaint against all of them for conspiring to defraud your company. While it's really hard for a cc processor to fight a cb and win -- and the cost incurred to third party processors is more than the $15 "administrative" fee that is charged (aside from any fines should your processor be in less than good graces with the cc company), depending on who took the charge they might take the correspondance from the parent and attempt to fight it. The trick of course is to get the 'father' to either lie or admit that there's nothing that should be cause for a chargeback.

It is not unheard of for adults to attempt to defraud pay sites with similar claims. This is of course credit card fraud, punishable by ... etc...blah blah. To receive your refund, simply send a signed written request for a refund and a copy of your son's birth certificate (or other legal documentation of his age and address and relationship to you) to: [Your corporate address.] In addition, I would appreciate receiving a call from your son (XXX-YYY-ZZZZ) to appologize to me for the costs that I have incurred as a result of his indescretion. Such a call can significantly speed your request through our fraud detection procedures.
