Someone please read this out loud for Shoehorn so he can understand that this is the way to get paid.

Not many fake nicks here, but I do see lots of real webmasters, that send real sales saying they will never touch you now.

I'm amazed that you continually miss the overall point. It seems everyone in this thread gets it but you.

Fact: Blockbuster STATES these rules in their TOS
Fact: YOU don't state anything of the SORT in your TOS

If you don't make your RULES clear, then how can anyone follow them?

YOU fucked up Dirty D. YOU forgot to include your own rules in your own TOS.

It doesn't matter that Blockbuster states it, it doesn't matter if every single other adult affiliate program states it in their TOS, if you DON'T then YOU don't have a leg to stand on. If you were to take this to court it would be pretty cut and dried; pay the man the money he is owed by your company, and update your TOS to reflect your OWN rules.

Your affiliates CANNOT read minds, and your affiliates will not PRESUME that you have rules in place that you do NOT state in your TOS.

It's time to own up to your own mistakes and pay Shoehorn. Being honourable and professional is far more important than keeping less than $500 in your pocket, isn't it?

here is my example... I have a webmaster that promotes our trademark 'xondemand' in google with 'xondemand videos' xondemand movies' etc... as long as the webmaster promotes XonDemand I am good with that...

while I also bid for these keywords my policy is to work with these webmasters and police our trademark... I allow my webmasters to promote our trademark... the way I see it is we have to pay for it so it saves me money if they pay the advertising and it makes the best conversion more then any other keywords, trademarks convert for keywords and some companies allow you to target it's trademark and other do not allow you to target..

I even give you lots of keywords to start with and tools to get more keywords for you...

this is my story and I am sticking to it...lol

I think you have a great program dirty d and I have never heard of any webmaster who you have not paid... I know you are working it out and trying to keep the webmaster happy but maybe your program is not for people who do not want to follow your trademark policy.. ;- good luck and work it out'

I have worked with Shoehorn for many years on lots of projects. He has always been a joy to work with and an overall great guy. I also know he sends lots of joins to several large companies. At this point it would be better to just pay him the money owed and stop being stubborn and acting like he did something wrong. This thread will not die and it will not be from fake nicks or basement dwellers. This is one of the only threads I have seen every person be on one persons side. Do the right thing and pay him the money owed. Seems like the best choice.

As a business owner myself I'm all about solving complaints and getting things turned around fast and with a positive spin rather than fire wall after wall of text at a problem that the masses don't agree with.

In other words wouldn't it have been better to just pay Johnny Shoehorn his 300 bucks or whatever and then let him decide if he wants to take advantage of the $100 PPS deal or discontinue doing business with you, and be done with it? Problem solved, no need for a trainwreck thread, no need to burn your valueable time posting damage control to the GFY shark tank.

And of course it should go without saying you should add some language to your TOS to reflect your wishes on affiliates doing PPC campaigns. Affiliates don't know everything, and the general rule is "when in doubt abide by the TOS". If a rule isn't in there then it's usually assumed that it's not an issue.

Business 101 really. Fix the problem and move on.

Yes that is marketing. It is called paid per click advertising (PPC), and wish shoehorn would take those keyword phrases that describe your site and send it to one of your competitors with a similar site. That is 100% legit, and is 100% marketing. If he doesn't I might just target all of your keywords and send them somewhere else because you are being such a dumb ass. Then you would be begging shoehorn to do what he was doing to try to get you all of that traffic back since you obviously don't have a clue how ppc works. Back on subject... Shoehorn needs to be paid, bidding on "crackwhore confessions" is not the same as bidding on the domain, and even if it was... this affiliate program never had it in its terms.

I would pull links personally.... or send to a different place.. maybe http://www.realcrackhoes.com/webmasters.htm ???

If the "World famous" crackwhore confessions was pulling a whopping 3 sales a month from a #1 adwords spot bidding on its name, then I have better things to do.
