Long story short I got hit in the head with a golf club by a guy in a whirlpool uniform who was OFF duty it was like 5:45 area..

I realize that suing just a person on aggravated assault is a losing cause basically no matter what since it can only cover expenses which are just stitches and a nasty headache...

BUT anybody have some info on if the guy was clearly in a big businesses uniform? right now I'm just glad the bleeding stopped and I hate lawyers so should I even think about talking to one once I get the police report? This happened more than an hour from home so I don't want to have to go back and forth if I don't have to.

I think you should at least have a consultation with an attorney and hopefully he'll be up front with you about your chances of winning vs. a realistic sum that you may be awarded. Also, make sure you tell him you're becoming agoraphobic and are terrified that there's a Tiger Woods just lurking around the corner with a nine iron. Emotional damages, baby!

Is there a way to swing a golf club at a persons head without ill intent? I went down to the ground and lost quite a bit of blood. The guy took off and cops were called but I got his plate number. I had gotten off a freeway to inspect if there were damages to my car when the guy came out of nowhere. It all started in a freeway area where it narrows to 1 lane with a ton of those barrels. I know I would have been able to kick the guys ass if he didn't have the club. Once I got hit by it though it was straight above my ear and I went dizzy and couldn't do a thing. my sun glasses ended up the other side of my car.

I have the name and number of 2 guys who saw it. They both said I wasn't doing anything that appeared even close to threatening.

I can understand road rage leading to fist fights but WTF? Getting hit by a GOLF CLUB? I was in a good area not far outside of South Bend with nothing but white people anywhere around.

My wifes a nurse and I've passed all possible tests but over 7 hours later I'm still bleeding. Normally I would take out the sewing kit and stitch myself but I can't reach this area. I've stitched myself up a dozen times for various things so as long as you REMOVE them properly it is safe to stitch yourself but it just hurts like hell but i'm tough. She won't stitch me so i'll probably make a trip to the ER for stitches sometime tonight.

i'll get a copy of the police report tomorrow and see how I feel. Personal lawsuits like this can only cover expenses but the lawyer takes a % so like I said those are ALWAYS a losing cause. After I get the Police report I think ill call the guys work and inform them he was wearing their shirt and fax the police report likely get the guy fired. Hopefully he'll get hit with the full felony and not plead down. Guys like this need some serious shit to come down on them. Some old friends of mine used to get into fist fights purely from being bored. I understand fist fights, they can actually be quite fun but to use a golf club is just crazy.

like I said earlier it was like 5:45 so he obviously recently got off of work since he was wearing the polo type shirt the office people wear and we were ~ 30 minutes south of the main Whirlpool HQ. ended up using some of that liquid bandaid on it because it didn't appear to be all that deep. I probably should have gotten stitches BUT I hate going to see a doctor. I slept with it wrapped up tight and it oozed quite a bit but it doesn't hurt me that bad anymore. Its down to just a dull ache. Hurts quite a bit worse when I chew something on that side of my head but in a few days I'll be perfectly fine. The bad headache went away overnight and I haven't had anymore dizziness.

The dry blood on my car is a bitch to get cleaned up but soap/water and scrubbing works.

He cut me off actually and drove me off the road...

it was on the freeway near South Bend. The right lane was closed up ahead and a semi had just passed me (I was driving a ton and didn't have anything important to do so I was driving in a way to get over 50MPG takes longer to get there but if you're not in a hurry might as well save some cash)

I was about half a carlength behind the semi in the right lane and there was another 6-8 cars in the left lane behind that car that cut me off. By time I was back fully on the road and looking to merge there simply wasn't room so I sped up and went around the semi which the guy must have taken for me chasing after him because as soon as I merged to the left lane I look back to in front of me to see nothing but brake lights which he went down to 20-30MPH and at that point I was around 70MPH from passing the semi so I clearly didn't have enough space to slam on my brakes so I went around and took out a couple construction barrels. The guy tailgated me for a bit and honked before a gap in barrels showed up and he jumped over to the blocked off lane and passed me + a car that I had caught up to. I tried to get off the next exit but at the last second the guy blocked the exit and actually came to a stop which I unbelted and was about to hop out when the guy took off. I figured I hit him so I pulled my car away from blocking the exit and got out the guy stopped up ahead of me a little bit and while I was checking my car he popped the trunk and grabbed a driver. My options were to jump in the car and run the guy over or stand there and see WTF he was gonna do. In my head I figure OK he's gonna smash the car or something I don't give a shit, it'll get fixed....

I know a guy that did the same thing and he went to prison for 5 years.

The cops weren't helpfull, here in MI they give you their business card with name rank and phone number. I wasn't given ANY contact info names or any information on even how to get the police report. I was told if they arrest this guy today they would be citing me for a road rage ticket and my license would likely be suspended. The cop even said hitting a barrel and driving on was leaving the scene of an accident. They were bending over backwards to try to talk me OUT of pressing charges and hell even intimidating me by talking about what they could cite ME with.

Obviously I wasn't thinking clearly at the scene since I just had pretty bad trauma to my HEAD and couldn't even drive home with the bleeding and dizziness. I'm going to call down there to try to track down a police report but honestly don't know who the hell to call. South Bend cops were there and like 3 other departments actually showed up and I even heard them fighting about who's area it was. They were even asking me tons of times if I was still in MI when it all started. Clearly the cops were trying to pass it on to somebody else and today I'm pretty pissed about the cops after I had time to think about it.

Anybody have suggestions on how to handle this? If they were to try to hit me with a road rage citation is that something I can fight or is it maybe one of those things that I just go to anger management or something on and you get a "freebie" after completing. Thinking things over though I don't feel like a road rage citation would be something I should get for this. I avoided several accidents. Road rage is more like driving wreckless not caring if you cause or get in an accident. I was DODGING an accident like 3 different times.

I'm waiting for the prosecutor to return my call. I'm not finding much info on the web about Indiana's policies on a road rage charge. I see only things about a bill that may or may not have passed. From reading THAT even by these "tougher" laws on it I don't think I could actually be convicted of it but until I get a police report and/or talk to the prosecutor I don't want to risk my license being suspended for 60 days which is the only penalty I'm finding...

bottom line is if they pursue road rage on ME it looks like at least 6 points along with possibly immediate termination of my license for 60 days. Stacking the points and the license suspension and michigans "driver responsibility" laws I could be paying $500-1k in fines AND not having my license for 2mnths AND my insurance going through the roof.

So I get a hit in the head and a couple months of HELL all for what? the satisfaction of knowing I put a criminal where he belongs? if he's a first time offender he'll plead down to something and get probation and a slap on the wrist.

You would think the system SHOULD work for us but the sad fact is it DOESNT!

Looking back on it there certainly is some funny shit in this... I certainly am glad to be perfectly fine out of it with no real damage. There are also ways to keep a case like this "pending" so that if he does something again before the statute of limitations runs out he's whacked for max penalties on this + the next charge.

Ill intent or not. contact the company he works for. Show them the police report, and most likely they will step up, take care of medical bills and put 10k into your pocket. No attorney, no bad press.

Other wise hint that you spoke to a friend at EX tv station and they said you should contact the company before the attorney. Kind of drops a hint you will go public. They dont need bad press.

As for sueing his employer it is quite posiable that you can....

Remember when we where in school... If you kicked someones ass on the way home even if it was off school property the school could punish you for it...

Same principal here... Companies are responsable for there employees actions to and from work... Why do you think big factories have huge locker rooms with showers and such..?

They encourage you to come to work in street clothes and change back into them at the end of the day... Some places it is policy...

They do not want there employees going out after work, having a few beers and getting in trouble with there logo on there chest...

I am having some minor issues with my head still tonight. When I bend over or do anything that increases pressure to my I get a little dizzy and it hurts. Right in the middle of the cut area and slightly above it there is a dent and its squishy. It hurts like hell to press so I could possibly have a skull fracture.

I went about a pretty normal day today. I worked on cleaning out the basement and mowed the lawn with a rider mower and used a trimmer to get all the edges. Its weird I feel pretty much fine but there's clearly something wrong. I'm going to make an appointment to see my normal doctor tomorrow and just have him schedule an x-ray. I don't feel like sitting in the ER all night just to get whacked by an insane bill.

By time the cops got the guy he had already changed his shirt but I'm sure at least one of the witnesses saw him wearing a whirlpool shirt. Since the guy is going to end up fired I won't exactly be seeing any cash from him if I sue and I can't really afford to be out a bunch of money right now. I've been putting off selling my '68 Mustang as long as possible and on my current budget I can keep it at least till spring but any shit can toss that off.

he closed the gap too quickly. Trying to get in the car would have just gotten me hit in the head (more likely the back of the head which is WAY too dangerous) My odds were better to stare the guy down like I did but I guess my staredown scared the guy.

Was it near the Benton Harbor/ St. Joe area? I see you are from Kalamazoo, I am currently a student at WMU in Kalamazoo. I lived in the St. Joe area for my junior/senior year of high school.

Sounds like a shitty situation, some stupid/crazy fucks come out of that Benton Harbor area. Hit me up on ICQ, recently just bought a new driver and I am pretty sure I could hit a car/head better than a golf ball, maybe I could get a few of the bad swings out before hitting the course with it! ;)

I realize that suing just a person on aggravated assault is a losing cause basically no matter what since it can only cover expenses which are just stitches and a nasty headache... BUT anybody have some info on if the guy was clearly in a big businesses uniform? right now I'm just glad the bleeding stopped and I hate lawyers so should I even think about talking to one once I get the police report? I probably should have gotten stitches BUT I hate going to see a doctor. I slept with it wrapped up tight and it oozed quite a bit but it doesn't hurt me that bad anymore. Its down to just a dull ache. Hurts quite a bit worse when I chew something on that side of my head but in a few days I'll be perfectly fine. The bad headache went away overnight and I haven't had anymore dizziness.
