Also, the notices which you have mentioned are just one tiny little part of the entire legislation.

I find it amazing that dumb, stupid webmasters think they satisfy the requirements of the whole act by simply accepting and responding to one of the various forms and notices proscribed in the legislation.

You can read a summary of the legislation here: http://www.copyright.gov/legislation/dmca.pdf

However to be fully compliant you're going to need lawyers to provide advice on the various things that you need to do in order to be compliant.

It's also worth noting that where you operate in a jurisdiction other than the USA you will also need to comply with local legislation which will usually included observing the various agreements and treaties entered into by your principal government.

I got you mate what you are actually trying to say , in other words the act was made in order to remove piracy not to leave a loophole like if they are removing then its ok but its not that i do understand and i also got you that u indirectly said that i was dumb and stupid ;)
Yes a person has to be in touch with the lawyers in order to learn and comply with the rules and regulations regarding the copyright laws of the country if not in the US
So in the end according to me you are trying to say its not just about answering to the DMCA the main thing is that u need to make sure that content doesn't get uploaded again and currently nowadays if a particular file is deleted it can be re-uploaded again and thats the problem that you are facing and thats is to why you are killing of the filelockers :)

It's obvious that you do not understand.

All of the file lockers being promoted at WJunction and UploaderTalk are unlawful, every single one of them.

It does not matter that they remove content when they receive a DMCA notice because they never had DMCA safe harbour in the first place as they have all deliberately set up a paid system of organised copyright infringement.

If you choose to do the same then we will crush you just as we will crush all the other infringers.

I am amazed that this site has paypal.

But then I suppose this is the new commercial reality.

If a site ticks all the boxes correctly on the due diligence then they get an account. The sums involved are to large to ignore.

We are working through this issue, however there are many different factors that make the Mega issue different from the vast majority of file lockers we have dealt with thus far.

However, my personal opinion is that Mega should not have Paypal.

Difference is they're New Zealand? Kiwi vs Aussie :)

Creatine 07-25-2013 10:43 AM

What's wrong with Mega? I believe they respond to DMCA complaints and they do not have any sort of affiliate or incentive to upload like all the other file lockers.

Are you guys trying to kill all file hosting websites in general? If so that is simply stupid. There is a need for file hosting services like mega, dropbox, and google drive.

It's the services that offer incentives and don't respond to DMCA that should be looked at.

If you think that Mega should be listed alongside Dropbox or Google Drive then you are a fool.

Mega is not of the same ilk as these services.

There is no reason to call anyone a fool. I may be ignorant to this subject so please enlighten me rather than name calling.

What is the difference between drop box and mega?

You upload files to both services and then you share the files.

True dat. It will never, ever be stopped, despite how many people AK calls names and threatens to "crush".

How long has he been trying this? Anyone see any impact on sales because of it? I've not seen any case studies.

judging by your background and other factors, stealing probably doesn't sound so deviant to you. It doesn't work and it drags everyone down.

Mega have a number of problems:

1. A large number of potentially illegal files.
2. The refusal to block (as they originally promised) search results from Mega-Search.me and other file search engines.
3. They have not demonstrated the same commitment to combating copyright infringement than is demonstrated by other legitimate cloud hosting services.
4. The only difference between them selling access to copyright content and not is the amount of free downloads available to non members of the site, Kim Dotcom can reduce the threshold at any time and then you will have MegaUpload MkII

There are other issues also that I will not discuss publicly as we do not wish to provide Mega with insight into how we will combat them.

In the past twelve months the number of file lockers accepting Paypal has gone from hundreds to just a few.

You have remarked yourself that the Epoch Paypal trial has produced some impressive sales numbers from Paypal, cutting off that source of income has mortally wounded most file lockers and leaves others dying.

We've virtually eliminated the sale of file locker vouchers from eBay having gone from a few hundred listings months ago to just a few now.

Any listings that do slip through have a life expectancy of a day before they are removed and in some cases the persons listing them have their eBay and Paypal accounts restricted.

By chipping away at all the various monetization methods used by the illegal file locker community we push this illicit industry further into the margins.

AdultKing 07-26-2013 09:30 PM

Pirates are usually pretty dumb, which is a good thing.

Isn't the internet entertaining all on it's own.

The cast being a mix of people, an international setting, intrigue, deceit, good guys, bad guys, It makes you want to grab a huge beverage, a generous amount of snacks and watch for hours daily.

Most everyone online will say more then they should if you let them talk long enough.

I've been dealing with one thief in particular who has been uploading my videos daily to RapidGator.net

RapidGator is complying with the DMCA's but they take almost a week to pull them down so the content is piling up faster than it's being removed.

Has anyone taken legal action against file lockers for not removing users like this one in particular? They are acknowledging that he doesn't have consent to upload the content yet they allow him to upload about 10 of my videos each day. He goes by the username PIMP20 and has uploaded literally tens of thousands of stolen videos to various lockers. I'm sure it's quite a little enterprise for him.

We don't let the actions of others dictate to us what we do in order to control or curtail people profiting from copyright infringement.

Sure, pirates will move from one file locker to the next. However we are in this playing the long game. We've killed off hundreds of sites and we'll keep pushing the infringing file lockers toward best practices or extinction.

As an individual rights holders there is little you can do directly, you probably don't have the funds required to hire the legal muscle you need to pursue these repeat uploaders, it's likely they have nothing to take in any case.

Rapidgator is on it's way to demise, they have had issues with payment processing for some time and are only paying some affiliates. The more pressure that can be put on them the more likely it becomes they will fail entirely.

That hasn't stopped us having their Paypal, Moneybookers, Payza, 2Checkout accounts terminated and funds frozen. It hasn't stopped them losing their merchant accounts.

As long as we can remove their money we will keep shutting down sites.

Embedding copyright infringing content is not lawful either.
