It's a good thing you are not a judge, or do not have any 'legal' merit. Yes we banned a few DMCA agents who had automated scripts hammering our database, and abusing our system, and it is well within our legal rights to block attacks.

Fail you worthless fuck. You are clearly stating you are banning the IPs of known DMCA Agents OR abusers. Banning the IPs of known DMCA Agents violates the Safe Harbor Exemption of the DMCA law. You can not enact any mechanism that makes it harder for copyright holders or their authorized agents to enforce their rights under the DMCA.

we have blocked some IP's of DMCA agents using scripts which was in essence ddos'ing our site. And that is an attack, we are well within our rights to block web attacks.

You can find many examples of genuine rights holders using our service to distribute their content and earn money from our pay per download model. I have given you one example of a forum which much traffic comes from. xda developers. I'm sorry I can't go in and browse around at everything everyone is uploading. I do value safe harbor.

I can't speak for fabian's motives in making a contribution. All I can say is that at no time has any favour been asked for and I have made it clear and consistent throughout that no favour would be given.

What I can say is that if you add up all of the money contributed by this industry I have matched that and then some out of my own pocket. In fact by the end of the year I will have put almost $100,000 of my own cash and in kind contributions to Copy Control and the IP Association.

Completely untrue. I have already stated clearly and openly that NO CONTRIBUTOR is afforded any favour, exemption, preference, special treatment or anything else. We cannot be bought.

You'll use any method of deflection to avoid the fact that you are an enabler of wide scale commercial copyright infringement. You pay people to upload infringing files. It's that simple.

The fact of the matter is, we would have ceased to exist a month ago without contributions, so I'll gladly accept funding from anyone, including you, but don't expect anything in return because you wont get anything in return.
